Terms of Business and Cancellation and Service Charges

We act on your behalf in arranging insurance cover with insurers to meet your needs; and helping you with any ongoing changes or claims you need to make. BDML holds money as agent of the insurer. We offer a range of personal insurances and have access to some of the leading insurers in the market place - for motor insurance we can select from around 16 insurers. A full list of insurers is available upon request. You will not receive advice or recommendation from us.

Who regulates us?
BDML Connect Ltd is authorised and regulated by the Financial Services Authority (FSA). Our FSA number is 309140. Our permitted business is arranging general insurance contracts. You can check this information on the FSA’s register by visiting the FSA’s Website www.fsa.gov.uk or by contacting the FSA on 0845 606 1234. BDML holds money as agent of the insurer.

What to do if you need to complain
If you have any complaint please phone our Customer Service Department on 0845 605 0145 or write to the Quality Manager, ASDA Financial Services, 1000 Lakeside North Harbour, Western Road, Portsmouth PO6 3EN. Maximum call charge from a BT landline is 4p per minute. Calls from other networks may vary. Please check with your network operator.

Should you remain dissatisfied with our response, you may approach the Financial Ombudsman Service. Full details of our complaint procedure are given in our Policy Booklet, a copy of which is available on request.

Charges
In addition to premiums charged by insurers we make the following charges:

Duplicate Documents
£20.00

Mid-Term Amendments
The administration charge for Mid-Term Amendments is £25 if an amendment results in a change in the premium (additional premium or return of premium). If the Mid-Term Amendment results in no change of premium then no charge will be made.

Cancellation of the policy within the first 14 days
If you decide to cancel the policy within the first 14 days, a pro rata refund will be made to you, less an administration charge of £20, provided there has not been a total loss claim and the certificate of motor insurance has been returned to us.

Cancellation of the policy
Your policy is a contract for twelve months. If your insurance is cancelled for any reason after the first 14 days a charge £50 will be made from the returned premium. There will be no return of premium if a claim has been made during the current year of insurance. If you pay by installments, please refer to your credit agreement.

There is no refund on Motor Legal Protection, Breakdown Service or Hire Car cover.

Withholding documents
We may keep certain documents such as your proof of no claim discount while we are awaiting payment of outstanding premium or administration charges. We will ensure that you have any documents you are required to have by law.

Keys in car exclusion
Theft claims will not be paid if the keys to the insured vehicle are left on or in the unattended vehicle.

Terrorism cover
Please refer to your schedule for any exclusions, terms and conditions relating to terrorism cover.

Renewal
We will automatically invite your renewal with our most competitive insurer. If you would prefer us to renew with your current insurer, please tell us. Before your renewal date we will send your renewal documentation detailing the premium payable and the terms and conditions. If you pay your premium by installments your policy will automatically renew with the most competitive insurer, unless we hear from you.If you do not wish your policy to renew, you should write to us.

Your Duty To Disclose
It is important that all information you give us verbally or in writing in proposing for, renewing or making changes to your insurance or making a claim is full and correct; and that you tell us about changes such as vehicle, address, occupation, drivers etc. Failure to do so could later invalidate your policy, or a claim made under it, or result in an increased premium or additional terms. It is an offence under the Road Traffic Act to make a false statement or withhold any material fact for the purpose of obtaining a Certificate of Motor Insurance. Under the conditions of your policy you must tell us about any insurance related incidents (such as fire, theft or an accident) whether or not they give rise to a claim. When you tell us about an incident we will pass information relating to it to a database.

Important Notice
Insurers pass information to the Claims and Underwriting Exchange Register, run by Insurance Database Services Ltd (IDS Ltd), the Hunter Database, run by MCL Software Ltd and the Motor Insurance Anti-Fraud and Theft Register run by the Association of British Insurers (ABI). The aim is to help us to check information provided and also to prevent fraudulent claims. When we deal with your request for insurance, we may search these registers. Under the conditions of your policy, you must tell us about any incident (such as an accident or theft) which may or may not give rise to a claim. When you tell us about an incident, we will pass information relating to it to the Registers. Your policy details will be added to the Motor Insurance Database (MID), run by the Motor Insurers' Information Centre (MIIC). MID data may be used by the DVLA and DVLNI for the purpose of Electronic Vehicle Licensing and by the Police for the purpose of establishing whether a driver's use of the vehicle is likely to be covered by a motor insurance policy and/or for preventing and detecting crime. If you are involved in an accident (in UK or abroad), other UK insurers, the Motor Insurers' Bureau and MIIC may search the MID to obtain relevant policy information. Persons pursuing a claim in respect of a road traffic accident (including citizens of other countries) may also obtain relevant information which is held on the MID. You can find out more about this from your insurer, or at www.miic.org.uk. We may search these databases when you apply for insurance, in the event of any accident or claim, or at time of renewal to validate your claims history or that of any other person or property likely to be involved in the policy or claim.

Fraud Prevention and Detection
In order to prevent and detect fraud we may at any time:

Share information about you with other organisations and public bodies including the Police;
Check and/or file your details with fraud prevention agencies and databases, and if you give us false or inaccurate information and we suspect fraud, we will record this.
We and other organisations may also search these agencies and databases to:
Help make decisions about the provision and administration of insurance, credit and related services for you and members of your household;
Trace debtors or beneficiaries, recover debt, prevent fraud and to manage your accounts or insurance policies;
Check your identity to prevent money laundering, unless you furnish us with other satisfactory proof of identity;
Undertake credit searches and additional fraud searches.

Data protection
For Data Protection Act purposes ASDA is the data controller.
We will hold and process your personal data, including sensitive data, for insurance administration and marketing. For this purpose, and to prevent fraud, the data may also be passed to selected third parties, insurers and reinsurers, and may be processed outside the EEA.
All personal data you supply must be accurate and you must have the specific consent of any other persons insured to disclose their personal data. You can ask us for more information about this. At the request of many of our customers and to make managing your insurance more convenient, it is our policy to accept information or instructions from your spouse or partner who calls us on your behalf, provided that they are named on the policy. You may ask us not to do this or you may nominate someone else if you wish. In any event we will only accept instructions to cancel or reduce cover or delete or change drivers from you personally.

Law applicable to this policy
You and we are free to choose the law applicable to this contract but in the absence of agreement to the contrary the law of England and Wales will apply.

Financial Services Compensation Scheme (FSCS)
The administrators and the insurer are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if we were unable to meet our obligations. This depends on the type of business and the circumstances of a claim. Insurance advising and arranging is covered for 100% of the first £2,000 and 90% of the remainder of the claim, without any upper limit. For compulsory classes of insurance, insurance advising and arranging is covered for 100% of the claim without any upper limit.
